CRYSTAL TOURS KENYA – TERMS & CONDITIONS

These Terms & Conditions govern all bookings for tours, safaris, travel packages, and related services arranged by Crystal Tours Kenya. By confirming a booking, you agree to be bound by these terms.


1. Booking & Confirmation

  • A booking is considered confirmed only upon:
    • Receipt of the required deposit or full payment; and
    • Issuance of a written confirmation (invoice or itinerary).
  • All bookings are subject to availability at the time of confirmation.
  • The company reserves the right to decline any booking at its discretion.

2. Payments & Pricing

  • All prices are quoted in United States Dollars (USD) or Kenyan Shillings (KES) unless stated otherwise.
  • A 30%–50% non-refundable deposit is required to secure bookings.
  • Full payment must be made 7–30 days prior to travel, depending on supplier terms.
  • Prices are subject to change due to:
    • Currency fluctuations
    • Government taxes or park fee changes
    • Supplier rate adjustments
  • Any pricing errors may be corrected before confirmation.

3. Cancellation Policy

Cancellation charges apply as follows (unless otherwise stated in your quotation):

  • 30+ days before travel: 25% of total cost
  • 15–29 days before travel: 50% of total cost
  • 7–14 days before travel: 75% of total cost
  • Less than 7 days / No-show: 100% of total cost

Important Notes:

  • Some lodges, camps, airlines, and peak-season bookings may have stricter policies.
  • Refunds (if applicable) are processed less any bank charges and third-party fees.

4. Amendments & Changes

  • Any changes to confirmed bookings are subject to availability and supplier policies.
  • Amendment fees may apply.
  • Changes in travel dates, accommodation, or number of travelers may result in price adjustments.

5. Travel Documents & Requirements

Clients are solely responsible for ensuring they have:

  • A valid passport (minimum 6 months validity)
  • Applicable visas
  • Vaccination certificates (e.g., Yellow Fever where required)
  • Travel insurance (strongly recommended)

Crystal Tours Kenya shall not be liable for denied entry, boarding, or travel disruptions due to incomplete documentation.


6. Travel Insurance

  • Travel insurance is highly recommended for all clients.
  • Coverage should include:
    • Medical emergencies
    • Trip cancellation/interruption
    • Loss of luggage

The company is not responsible for losses that could have been covered by insurance.


7. Client Responsibilities

  • Clients must provide accurate personal information (names must match passport details).
  • Any errors may result in penalties or denied services.
  • Clients are expected to:
    • Follow local laws and regulations
    • Respect wildlife and conservation rules
    • Follow guide and safety instructions at all times

8. Health & Safety

  • Clients must ensure they are medically fit for travel.
  • Any medical conditions must be disclosed prior to travel.
  • Crystal Tours Kenya is not responsible for health-related incidents during travel.

9. Accommodation & Transport

  • Accommodation is subject to availability and hotel policies.
  • Check-in/out times are determined by respective properties.
  • Transport (safari vehicles, flights, transfers) is arranged through third-party providers.
  • Delays due to weather, road conditions, or technical issues may occur.

10. Itinerary Changes

  • The company reserves the right to:
    • Alter itineraries due to weather, safety, or operational reasons
    • Substitute accommodation or services with similar standards

No refunds will be issued for unused services or missed activities beyond the company’s control.


11. Liability Disclaimer

Crystal Tours Kenya acts as an intermediary between clients and service providers (hotels, airlines, transport companies, parks).

We shall not be held liable for:

  • Injury, illness, accident, or death
  • Loss or damage of personal belongings
  • Delays, cancellations, or disruptions
  • Acts of God (weather, natural disasters)
  • Political unrest, strikes, or government actions

Our liability is limited to the amount paid for the booking.


12. Force Majeure

The company shall not be liable for failure to perform obligations due to circumstances beyond its control, including:

  • Natural disasters
  • Pandemics
  • War or civil unrest
  • Government restrictions

In such cases, alternative arrangements or credits may be offered at discretion.


13. Special Requests

  • Requests such as:
    • Room type
    • Dietary requirements
    • Seating preferences
      are not guaranteed and depend on suppliers.

14. Luggage & Personal Belongings

  • Clients are responsible for their luggage and valuables at all times.
  • The company is not liable for loss, theft, or damage.

15. Governing Law

These Terms & Conditions are governed by the laws of the Republic of Kenya.
Any disputes shall be subject to the jurisdiction of Kenyan courts.


16. Acceptance of Terms

By confirming a booking, the client acknowledges that they:

  • Have read and understood these Terms & Conditions
  • Agree to be bound by them
