These Terms & Conditions (“Agreement”) govern all bookings, reservations, travel arrangements, safari packages, tours, excursions, and related services (“Services”) provided by Crystal Tours Kenya (“the Company”, “we”, “us”, “our”).

By making a booking, paying a deposit, or using our Services, you acknowledge that you have read, understood, and fully agree to be legally bound by these Terms & Conditions.


1. BOOKING PROCESS & CONFIRMATION

1.1 All bookings are subject to availability at the time of confirmation. Availability is not guaranteed until written confirmation is issued by the Company.

1.2 A booking is only deemed confirmed when:

  • The required deposit or full payment has been received; and
  • The Company issues a written confirmation document (invoice, receipt, or itinerary).

1.3 The Company reserves the right, at its sole discretion, to accept or decline any booking without obligation to provide reasons.

1.4 Any verbal discussions, quotations, or preliminary itineraries do not constitute a confirmed booking.


2. PRICING, PAYMENTS & CURRENCY

2.1 All prices are quoted in United States Dollars (USD) or Kenyan Shillings (KES) unless otherwise stated.

2.2 Prices are based on prevailing supplier rates, government taxes, park fees, fuel costs, and exchange rates at the time of quotation.

2.3 The Company requires a non-refundable deposit of 30%–50% to secure all bookings. The exact deposit amount will be stated in the invoice.

2.4 Full payment must be completed:

  • Between 7 to 30 days before departure, depending on supplier requirements; or
  • Immediately for last-minute bookings.

2.5 Failure to make full payment within the stipulated time may result in automatic cancellation of the booking without refund.

2.6 The Company reserves the right to adjust prices due to:

  • Currency fluctuations
  • Changes in government taxes, park fees, or levies
  • Supplier rate adjustments
  • Fuel surcharges or operational costs
  • Errors or omissions in pricing

2.7 Any pricing errors identified before confirmation may be corrected without liability.


3. CANCELLATION POLICY

3.1 All cancellations must be submitted in writing via email.

3.2 Cancellation charges apply as follows unless stricter supplier conditions apply:

  • 30+ days before travel: 25% of total booking cost
  • 15–29 days before travel: 50% of total booking cost
  • 7–14 days before travel: 75% of total booking cost
  • Less than 7 days / No-show: 100% of total booking cost

3.3 Certain services (including luxury lodges, peak season bookings, flights, and special promotions) may be 100% non-refundable from the time of booking.

3.4 Refunds, where applicable, will be processed after deduction of:

  • Bank charges
  • Transaction fees
  • Supplier cancellation penalties

3.5 Refund processing timelines depend on third-party providers and may take up to 30–90 days.


4. AMENDMENTS & MODIFICATIONS

4.1 Any request to modify confirmed bookings is subject to availability and supplier approval.

4.2 Amendment fees may apply in addition to any supplier penalties.

4.3 Changes to travel dates, accommodation, transport, or number of travellers may result in revised pricing.

4.4 The Company is not obligated to accommodate change requests, particularly during peak seasons.


5. TRAVEL DOCUMENTATION & ENTRY REQUIREMENTS

5.1 Clients are solely responsible for ensuring they possess valid travel documents including:

  • Passport valid for at least six (6) months beyond travel dates
  • Valid visas and permits
  • Required vaccination certificates (e.g., Yellow Fever where applicable)

5.2 The Company shall not be held responsible for:

  • Denied boarding or entry
  • Immigration rejection
  • Missing or invalid documentation
  • Travel disruptions due to documentation errors

5.3 Any resulting costs shall be borne entirely by the client.


6. TRAVEL INSURANCE (MANDATORY RECOMMENDATION)

6.1 Comprehensive travel insurance is strongly recommended for all clients.

6.2 Insurance coverage should include:

  • Medical emergencies and evacuation
  • Trip cancellation or interruption
  • Personal accident and liability
  • Loss or theft of luggage and personal belongings

6.3 The Company shall not be liable for any losses that could have been covered under a valid insurance policy.


7. CLIENT RESPONSIBILITIES

7.1 Clients must ensure all personal details provided are accurate and match official travel documents.

7.2 The Company shall not be liable for errors arising from incorrect information provided by the client.

7.3 Clients agree to:

  • Comply with all local laws and regulations
  • Respect wildlife, conservation rules, and park regulations
  • Follow safety instructions provided by guides and staff
  • Behave responsibly throughout the trip

7.4 The Company reserves the right to terminate services without refund if a client behaves in a disruptive, unsafe, or illegal manner.


8. HEALTH, FITNESS & MEDICAL CONDITIONS

8.1 Clients confirm they are medically fit for travel.

8.2 Any pre-existing medical conditions must be disclosed prior to booking.

8.3 The Company is not responsible for:

  • Medical emergencies
  • Injury, illness, or death during travel
  • Costs associated with medical treatment or evacuation

9. ACCOMMODATION, TRANSPORT & THIRD PARTIES

9.1 All accommodation and transport services are provided by independent third-party suppliers.

9.2 The Company acts only as an intermediary and does not own or operate such services.

9.3 Check-in and check-out times are determined by respective properties.

9.4 The Company is not liable for:

  • Delays, cancellations, or overbooking
  • Mechanical failures or transport breakdowns
  • Weather-related disruptions
  • Service quality differences from expectations

10. ITINERARY ALTERATIONS

10.1 The Company reserves the right to modify itineraries where necessary due to:

  • Weather conditions
  • Safety concerns
  • Operational requirements
  • Government or park regulations

10.2 Equivalent alternatives will be provided where possible.

10.3 No refunds will be issued for unused services, missed activities, or voluntary withdrawal from the itinerary.


11. LIABILITY DISCLAIMER

11.1 The Company acts as an agent between clients and service providers.

11.2 To the fullest extent permitted by law, the Company shall not be liable for:

  • Injury, illness, or death
  • Loss or theft of personal property
  • Delays, cancellations, or schedule changes
  • Natural disasters or acts of God
  • Political instability, strikes, or government actions

11.3 The Company’s total liability, if any, shall be strictly limited to the amount paid for the affected booking.


12. FORCE MAJEURE

12.1 The Company shall not be liable for failure to perform obligations due to events beyond its reasonable control, including but not limited to:

  • Natural disasters
  • Pandemics or epidemics
  • War, terrorism, or civil unrest
  • Government restrictions or border closures
  • Industrial disputes or strikes

12.2 In such cases, the Company may:

  • Reschedule services
  • Offer travel credit
  • Provide alternative arrangements (where possible)

13. SPECIAL REQUESTS

13.1 Special requests such as room preferences, dietary requirements, or seating arrangements are subject to availability.

13.2 The Company does not guarantee fulfillment of special requests.


14. BAGGAGE & PERSONAL BELONGINGS

14.1 Clients are solely responsible for their luggage, valuables, and personal belongings at all times.

14.2 The Company is not liable for any loss, theft, or damage.


15. PHOTOGRAPHY & MARKETING

15.1 The Company may capture photographs or videos during tours for marketing purposes.

15.2 Clients who do not wish to appear must notify the Company in writing prior to travel.


16. GOVERNING LAW & JURISDICTION

16.1 These Terms & Conditions are governed by and interpreted in accordance with the laws of the Republic of Kenya.

16.2 Any disputes shall be subject to the exclusive jurisdiction of Kenyan courts.


17. ACCEPTANCE OF TERMS

By confirming a booking or making payment, the client acknowledges that:

  • They have read and understood these Terms & Conditions
  • They agree to be legally bound by them
  • They accept all risks associated with travel
